Pennsylvania Drunk Driving State Guidelines


Under new state guidelines, the BAC threshold for DUI / DWI charges have become more stringent than ever.  A blood alcohol concentration of just .08 percent violates the limits of the new law.  The new law also prescribes harsher penalties if the driver’s blood alcohol content falls above this minimum level.  The three levels and their respective blood alcohol contents are:

General impairment - .08-.099%
High impairment      - .10-.159%
Highest impairment - .16 and above



Drunk Driving Penalties

The penalties for these DUI / DWI offenses can be harsh. For example, a “general impairment” conviction can result in six months probation and a $300.00 fine for a first offense, and 48 hours to six months imprisonment and fines of $500.00 to $5000.00 along with a mandatory 12 month license suspension and enrollment in a driving school for a second offense.
